Much to my surprise after waiting 9 &$#&*&$ weeks for my unemployment benefits status I find out that they denied my claim due to "voluntarily" leaving.
I was FIRED. I could not come to work due to medical purposes and doctor's orders stating I was not fit to even drive let alone work.
So after the 9 week period, I have to wait yet another 6 weeks for the appeal decision to be heard.
My wonderful past employer told them that I never came and groveled for my job back, nor did I tell them that I had a condition, give them documentation, or have a valid reason for not being there.
Let's explore all those, shall we?
1. I was unaware that the law states you have to beg and plead for your job back or it's considered a voluntary separation. Apparently, I am not protected under ADA nor anything to do with medical accommodations.
2. They were advised of my disability the day I was hired. They were also advised
the day that my fainting, dizziness, seizures, vomiting, nausea, and memory loss started on 3/18.
3. I spoke to them every single day advising them of my doctor's visits and gave them all documentation from my doctor. Legally, I only need to give them the doctor's excuse.
4. So? I guess blacking out, fainting, dizziness, constant vomiting, nausea, memory loss, and fatigue weren't valid for not working. I guess I could have just sat with my face in the keyboard and blacked out there.
This country does not help in any way for people like me. The southern states are notorious for dicking peoples benefits. I'm fed up. I truly cannot stand living in TN right now. It's total garbage.
